Terms of Service

These Terms of Service ("Terms") govern your use of zaphia.ai (the "Site") and your purchase and use of digital products offered by Zaphia AI ("Zaphia AI", "we", "us", or "our"). Please read them carefully.

1. Acceptance of these Terms

By using the Site or buying a product, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the Site or purchase our products. If you are buying on behalf of a business, you confirm you are authorized to accept these Terms for that business.

2. What we sell

Zaphia AI sells instant-access digital products, including "AI Visibility Kits" and downloadable PDF guides and templates (the "Kits"). All products are digital downloads. We do not sell physical goods, and we do not offer subscriptions at launch.

3. Payments and Merchant of Record

Checkout and payment are handled by Lemon Squeezy, which acts as the Merchant of Record for your purchase. This means Lemon Squeezy is the seller of record: it processes your payment, handles applicable sales tax and VAT, and applies its own buyer terms. When you buy a Kit, you also agree to Lemon Squeezy's terms and privacy policy. Your receipt and billing records come from Lemon Squeezy.

4. License to use the Kits

When you buy a Kit, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Kit's content for your personal use or within a single business you own or operate.

You may not:

  • Resell, sublicense, redistribute, share, or give away the Kit files or templates.
  • Republish the content as your own product or as part of a competing product.
  • Use the content to train, fine-tune, or build a competing dataset or model.
  • Remove or alter any copyright, trademark, or attribution notices.

You may adapt the templates for your own business's use (for example, filling in your own details and publishing the resulting content on your own website).

5. Intellectual property

The Site and the Kits, including all text, templates, designs, graphics, and other content, are owned by Zaphia AI or its licensors and are protected by copyright and other intellectual property laws. Except for the license in Section 4, no rights are transferred to you.

6. Disclaimers

The Kits provide general guidance and educational information only. They are not legal, medical, compliance, financial, or professional advice, and using them does not create any professional or advisory relationship. You are responsible for how you apply the content and for meeting any laws or regulations that apply to your business.

We do not guarantee any specific outcome. In particular, we make no guarantee of improved search rankings, visibility, traffic, AI citation or inclusion in AI-generated answers, revenue, or any other result. Search engines and AI systems are controlled by third parties and change constantly.

The Site and the Kits are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by law, Zaphia AI and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Site or the Kits. Our total liability for any claim relating to a Kit will not exceed the amount you paid for that Kit. Nothing in these Terms limits liability that cannot be limited by law (for example, certain statutory consumer rights).

8. Acceptable use

You agree not to:

  • Use the Site or Kits for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorized access to the Site, its systems, or its data.
  • Interfere with or disrupt the Site, introduce malware, or scrape content at scale.
  • Infringe the rights of Zaphia AI or any third party.

We may suspend or terminate your access if you breach these Terms.

9. Third-party links and services

The Site may link to third-party sites and services (such as Lemon Squeezy, MailerLite, and others). We are not responsible for their content, terms, or privacy practices. Your use of them is at your own risk and subject to their terms.

10. Refunds

All sales are final and non-refundable because our products are instant-access digital downloads. Please see our Refund Policy for full details, including the EU/UK right-of-withdrawal waiver and Lemon Squeezy's role as Merchant of Record.

11. Governing law

These Terms are governed by the laws of California, USA, without regard to conflict-of-law rules. Any disputes will be handled in the courts of that jurisdiction, unless mandatory local consumer law gives you other rights.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and change the "Last updated" date. Your continued use of the Site or a new purchase after changes means you accept the updated Terms.
